GENERAL AND LEGAL OBLIGATIONS

Terms of Use
toworq.com is a system which enables the candidates to upload their applications, consisting of CV, LANGUAGE PASSPORT, SKILLS PASSPORT and Cover Letter prepared in compliance with the standards determined by CEDEFOP (European Center for the Development of Vocational Training), who want to work or do internship in Europe free of charge through the portal to the database and which enables toworq.com users to view them while optionally such CVs can be reviewed, edited and improved by German experts for certain a fee and which ensures the candidates to submit their applications directly to employers in Europe via the system.

User Types
toworq.com has 4 different user types in addition to those working within the structure thereof: for visitors, individuals members(looking for internship abroad) membership, individuals (job seekers)and corporate members.

Visitors
Visitors are users who are not yet members or who have not made member log in to toworq.com. Visitors are obliged to comply with the terms and conditions specified in this agreement like all users.

Individual Membership (Looking for Internship Abroad)
The candidate who is looking for a company where he/she can do internship abroad must be a member of the site in order that he/she can benefit from the services offered through toworq.com. The CV, Cover Letter, Language Passport and Skill Passport, which he/she has arranged in line with the sector preference he/she wants to work with, are recorded in the database.  Upon request, if the Internship Package is purchased, all documents which are recorded in the system are examined through German HR experts and provide their feedback in addition to editing, modification and improvement recommendations to the user via the portal. Following the necessary editing, the application is sent directly to the human resources of 250 companies that are members of toworq.com in line with the sector (s) which the user has chosen. (A confirmation e-mail is sent to the user additionally.) If the user buys the optional Premium Internship package, the cover letter is created by toworq in addition to the services specified hereinabove and subsequently the user’s file is prepared and sent to 50 companies via mail.

toworq.com cannot be held liable for the content and correctness of the candidate’s information recorded in the database. The risk regarding the content of the candidate’s information belongs to the candidate.

The candidate looking for an internship abroad has read and accepted the following conditions that he/she should not provide false or misleading information when signing up or updating his/her membership, he/she will not use other persons’ personal information as if they are his/her personal information, he/she is fully responsible for all the information he/she gives and that these information  and his/her resume will be available during the search of corporate members or/and they will be sent to corporate members by e-mail.

Individual Membership (Job Seeker)
The candidate who is looking for a job abroad must be a member of the website in order to benefit from the services offered by toworq.com. His/her CV, Cover Letter, Language Passport and Skill Passport which he/she has prepared in line with the sector he/she prefers to work with, are recorded in the database  are opened to the search of corporate users of toworq.com. Upon request, if the Pro Package is purchased, all documents which are recorded in the system are examined through German HR experts and provide their feedback in addition to editing, modification and improvement recommendations to the user via the portal. (In addition, notification is made to his/her e-mail address recorded in the system). Following the necessary editing, the application is sent directly to the human resources of 500 companies that are members of toworq.com in line with the sector (s) which the user has chosen. (A confirmation e-mail is sent to the user additionally.) If the user buys the optional Premium Pro package, the cover letter is created by toworq in addition to the services specified hereinabove and subsequently the user’s file is prepared and sent to 50 companies via mail.

Individual Member; Approval and Right to Reject Electronic Message 
The candidate looking for a Job/Internship enters a valid e-mail address when signing up at toworq.com. This e-mail address is also the username used by the candidate for password to log in to the site. The candidate can change his/her password at any time. By accepting this Agreement, the candidate accepts and declares that toworq.com may engage in the above-mentioned communication activities with him/her unless he/she has a request otherwise. The candidate can unsubscribe from the mailing list at any time through the account settings to which he/she has entered with a password or by using the "I want to unsubscribe" link in the e-mail sent to him/her. toworq.com will stop sending e-mails to the candidate within three business days at the latest after the request is received.

The candidate can also specify his/her phone numbers and different e-mail addresses in his/her resume, which  he/she has saved on toworq.com. Member companies to which the candidate has applied for a job can contact the candidate his/her via phone number or e-mail address. The candidate can change his/her phone numbers or e-mail addresses by updating his/her resume at any time.


Corporate Membership
The employer’s authorized officer becomes a member by filling out the company membership form on toworq.com. He/she enters his/her company name, the e-mail address through which he/she  wants to receive the CVs, and information as the sector from which he/she  needs staff and the city he/she  lives in the company membership form. If his/her membership information is checked and approved by toworq.com, the employer is registered as a Member in the company database. Membership is free and fro an indefinite time. An automatic password is defined and communicated by e-mail to the employer who is member of toworq.com. The employer member can change his/her password at any time.

toworq.com sends the candidate's CV that is in line with the sector-position and city preferences as well as  newly registered candidates every day via e-mail to the member company. 

Corporate Member; Approval and Right to Reject Electronic Message 
The company looking for employees enters a valid e-mail address when signing up at toworq.com. This e-mail address is also the username used by the company for password to log in to the site. . toworq.com has the right to send membership information, send candidate CVs and job applications that match their preferences to the company , notify the company about corporate membership prices, campaigns and new issues related to the site, and contact the company through this e-mail address provided that the company does not go beyond its membership purpose. By accepting this Agreement, the company accepts and declares that toworq.com may engage in the above-mentioned communication activities with him/her unless he/she has a request otherwise. The company can unsubscribe from the mailing list at any time through the account settings to which he/she has entered with a password or by using the "I want to unsubscribe" link in the e-mail sent to him/her. toworq.com will stop sending e-mails to the candidate within three business days at the latest after the request is received.

Membership Update
toworq.com gives its members the opportunity to update and change their membership information at any time.


Unsubscribing

toworq.com members have the right to delete their registration and terminate their membership at any time.


Membership Restriction or Cancellation
In the event that the conditions written in this contract are not complied with or if the membership information cannot be verified, toworq.com reserves the right to prevent the member from accessing the services, accessing the membership information, changing or deleting the membership information or canceling the membership completely.


Obligations Applicable to All Users
All users using toworq.com accept the following issues:


-All users will respect the usage rights, privacy rights and personality rights of other users and will not be disturbing other users,
-Users will not provide false information about themselves,
-Users will not attempt to access sections without access permission,
-Users will respect the promotion rights,
-Users will not engage in activities that might prevent the working of software used on the site by viruses or various methods,
-Do not send any commercial advertisement containing software or information during the communication on the site,
-Users accept that they will comply with all these rules during use of the website and if users do not comply with these rules they will be the only responsible party for the results that may arise. In the event that the specified rules are not followed, toworq.com does not accept any responsibility and reserves the right to take legal action.

CV Submission

toworq.com sends the CVs of members who have purchased any of the Erasmus/Internship, Pro or Premium Packages to the employer members in the system via e-mail and reports this in the "Submission Report".
However, the responsibility does not belong to toworq.com if the companies do not review the CV or the CV does not reach the company due to the system error of the company.

Copyrights
All rights of software, codes, designs, logos, writings, graphics, photos, images and ideas in toworq.com are reserved. Any material on the website cannot be used, changed, copied, reproduced, forwarded, distributed, published on another site or given a link thereof.


Links to Other Sites
You are considered to have completely left toworq.com website when you connect to another site from any link on toworq.com. The presence of these links on toworq.com does not mean that they are approved by toworq.com. If the usage agreements are not observed, toworq.com is not responsible for the content of the website directed by the link and the consequences. We recommend that you read the usage agreement of each site you visit carefully.


Information Accuracy and Compliance with Laws
toworq.com is not responsible for the content of membership information filled by job seekers and employers. toworq.com does not guarantee the accuracy and reliability of such information. The only responsible party for this information is the institution or individual that is the source of the information. toworq.com does not guarantee the accuracy, reliability and legitimacy of the information (individual or corporate) in the communications that a user will do with another user through toworq.com. If the information is illegal, toworq.com accepts no liability for any dispute which may occur during or after communication and situations like this. Responsibility is owned by the relevant parties.


Damages Due to Use of the Site
toworq.com cannot guarantee that there are no viruses or dangerous elements on the website. toworq.com does not accept responsibility for any damage caused by the use of the site. toworq.com cannot be held responsible for the problems and damages that may arise in virtual environment or outside during the use of any document, service or information presented on this site .
Update
toworq.com reserves the right to change the contents of the website temporarily without prior notice. You will be notified by e-mail what you need to do if any changes made to the site affect you.


Principles of Privacy 
toworq.com attaches great importance to the privacy and security of member information. Accordingly, the service provider hosting the member information database is protected by virtue of "firewalls" using the latest technology.


Protection of Personal Data
Personal data, in accordance with the Law on Protection of Personal Data, is collected, protected and processed by toworq.com (to worq UG) as the data controller. Privacy and security of personal data is essential.

Companies which are members of toworq.com can contact the candidates for evaluation during the recruitment process.
You can find details on this subject and our data policy in the "Clarification Text on Personal Data Protection Law".


Technical information
There are also some technical information to be obtained when visiting toworq.com in addition to the personal information provided by the members as follows: IP address, server, connection times to the website, internet service provider (ISP) ... This information is recorded in order to quickly and easily troubleshoot technical problems. The foregoing information is not shared with third parties.


CV Information
It is explained under which conditions and with whom the CV information will be shared:


With the companies to send CV;
CV information that the job seeker has filled in with his consent and previously prepared by himself  is sent to the employer members who are members of the system via e-mail if any package is purchased and CV information can be viewed by employer members by searching the database toworq.com, whether they purchase a package or not.
toworq.com does not accept any responsibility if the job seeker member shares his other personal information by his own will with the employers.


With the service provider;
toworq.com databases and website software are located on the servers of the service provider company. The service provider company may not use, share, sell or rent this information for any other purpose. The service provider company is under this obligation in line with the Confidentiality Agreement it has signed with toworq.com.


With other websites;
There are links to some other websites on toworq.com. The confidentiality agreements of the websites visited through these links are different from those of toworq.com and toworq.com accepts no responsibility for the problems that occur there and does not guarantee the security and confidentiality agreements of those sites.


As regards legal investigation request;
In case of any legal investigation, toworq.com is obliged to share the member information with the relevant authorities within the framework of the laws.

In case toworq.com is sold to another company or becomes partner with another company;
If toworq.com is bought or becomes partner with another company or companies, it reserves the right to share all information with the other company or companies.


Password Protection
toworq.com only allows access to the parts containing personal or corporate information with a password in order to protect the privacy of member information. The system does not allow two people to log into the system at the same time with the same username and password. The confidentiality of the password is within the responsibility of the member. The member is responsible for the problems that may arise as a result of giving the password to another person. The member is obliged to notify toworq.com if he/she finds out that his password is used without permission. toworq.com advises members to change their passwords from time to time for the security of their information. Furthermore, toworq.com reserves the right to change your password if such change is necessary for the security of the website.


Children
toworq.com attaches importance to the protection of personal data of children under the age of 18. Membership of the website is within the responsibility of the parent or legal representative. If a parent notices that their child is a member without their consent, they can delete this membership on toworq.com, or request from toworq.com to delete such membership.
Limits of the Confidentiality Agreement


If the member information is captured by others in any illegal way although all necessary security precautions are taken, the legal responsibility of this is for those who violate the law and receive the information. If you determine such a situation, please let us know. In such a case, we will exercise our legal rights and initiate legal action on the issue.


Legal warning
German law will be primarily taken into consideration in the execution of this agreement and the issues which may arise during the use of the website. If any article in this agreement is illegal, invalid or unenforceable under German law, that article of this agreement will be invalid and the remaining articles will remain valid.

Issues which do not exist and are not foreseen on the date of signing of the agreement and which develop outside the control of the parties, which make it impossible for one or both of the parties to fulfill the responsibilities thereof undertaken by the agreement (natural disaster, war, terrorist strike, lockout, significant failure in facilities etc.) will be considered as force majeure. The party incurring force majeure will notify the other party immediately and in writing. The parties will not have any responsibilities as they cannot fulfill their obligations during the continuation of the force majeure conditions. If these force majeure conditions persist for ten days, each party will have the right to terminate the agreement unilaterally.
